Terms of Service

1. Acceptance

By creating an account or using Tesphase (the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. What Tesphase does

Tesphase is a software service that reads solar production and vehicle state from third-party systems you connect (for example, Enphase and Tesla) and sends charging commands to your vehicle based on available solar power. You remain the owner and operator of your vehicle and solar system at all times.

3. Eligibility

You must be at least 18 years old and capable of forming a binding contract. You must own or have authorized access to the vehicle and solar system you connect.

4. Your account

You are responsible for the security of your password and for any activity that occurs under your account. Notify us at info@tesphase.co if you suspect unauthorized access.

5. Third-party services

Tesphase relies on APIs operated by Tesla, Enphase, and other providers. Those services are governed by their own terms and privacy policies. We are not responsible for outages, rate limits, policy changes, or other actions taken by these providers that may affect Tesphase’s ability to function.

6. Charging commands and battery wear

Tesphase issues charging start, stop, and amperage commands to your vehicle on your behalf, only when you have explicitly connected your vehicle and granted the required OAuth scopes. You acknowledge that frequent charging adjustments are within normal vehicle operating parameters as documented by the manufacturer, but Tesphase makes no warranty regarding battery longevity, vehicle warranty status, or compatibility with future firmware updates from your vehicle manufacturer.

7. No warranty

The Service is provided “as is” and “as available,” without warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that charging decisions will maximize savings under your specific utility rate plan.

8. Limitation of liability

To the maximum extent permitted by law, Tesphase and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising out of or related to your use of the Service. Our total liability for any claim shall not exceed the amount you paid for the Service in the twelve months preceding the claim, or one hundred U.S. dollars, whichever is greater.

9. Account termination

You may delete your account at any time from Settings → Account. We may suspend or terminate accounts that violate these Terms or that pose a security risk.

10. Changes

We may update these Terms from time to time. Material changes will be posted to this page with an updated “Last updated” date. Continued use after a change constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of laws principles. Any dispute shall be resolved in the state or federal courts located in San Francisco County, California.
